- Residential Tenancy Branch
AnonDec-154063
We represented the Tenant in a Residential Tenancy Branch dispute, successfully defending against a $33,800 claim for unpaid rent. The tribunal found no formal tenancy agreement and determined that payments were voluntary due to family circumstances, particularly the tenant’s wife’s illness. The landlord’s delay in pursuing the claim and the broader family disputes also contributed to the dismissal. The claim and the request for the filing fee were both denied.
- Residential Tenancy Branch
AnonDec-195562
We represented the landlord in a dispute regarding the tenant’s application to cancel a 10-Day Notice for unpaid rent, seek compensation for an alleged illegal rent increase, and recover filing fees. The tenant vacated on December 15, 2024, making the cancellation request moot. The adjudicator found the tenant was aware of the increases, chose to pay them rather than dispute them earlier, and failed to mitigate their losses. The tenant’s claims were dismissed in their entirety, without leave to reapply.
