Tenancy disputes we help with in Nanaimo

Notices to End Tenancy

Notice advice starts with the legal ground, the approved form and how the document was delivered. BC currently uses three-month landlord or purchaser occupancy notices; a renovation requiring vacant possession generally needs an RTB order rather than a landlord-issued renovation notice.

Disputing an eviction

Challenging a notice means more than telling the landlord you disagree. We review the filing deadline, identify the grounds for a response and prepare evidence for the requested cancellation.

Orders of possession

A landlord seeking the rental unit back may need an RTB possession order. Tenants should assess their response promptly, and both parties should understand the legal process before acting on an order.

Unpaid rent and damage claims

Rent ledgers, inspection records and invoices can support a claim for money. We review the amount sought and help respond where liability, causation or the claimed loss is disputed.

Security and pet damage deposits

Deposit disputes depend on the move-out record and what happened next. We help tenants request repayment and landlords understand when a claim, consent or other statutory rule may apply.

Rent increases

We help tenants assess proposed increases and landlords understand the requirements before issuing them. Timing, form and any authorized exception matter alongside the percentage permitted for the relevant year.

Repairs and services

We help present evidence about unresolved maintenance and a loss of included services. Keep dated requests, responses and photographs; the right remedy depends on the obligation and the actual facts.

Quiet enjoyment

Quiet-enjoyment issues can involve interference or privacy concerns. Our advice focuses on the severity, frequency and evidence of the alleged conduct, and the remedy sought by the affected party.

Enforcing RTB orders

If an order is not complied with, review its terms before proceeding. Advice addresses the appropriate court filing and avoids confusing lawful enforcement with a unilateral eviction or deduction.

For tenants in Nanaimo

A Nanaimo tenant served with a cause notice should collect the cited warnings and correspondence as well as the notice. Identify what conduct is alleged and what response you gave. The deadline to apply is separate from informal discussions about whether the landlord will withdraw it.

A hearing is a chance to explain relevant facts, not every disagreement with the owner. Connect each item of evidence to the remedy requested and keep an accessible copy during the call.

For landlords in Nanaimo

Nanaimo landlords considering a cause notice should examine the statutory ground rather than relying only on a lease label. Gather the incident record, warnings and replies. Explain the conduct and its significance without assuming every disagreement supports ending the tenancy.

A practical resolution may involve a written payment arrangement or move-out agreement. Check its terms carefully and do not assume negotiations have preserved an application deadline.

How the RTB dispute process works

Before a Nanaimo hearing, separate the application deadline from the evidence deadline. The overview below helps place each task in order; your case package supplies the binding instructions.

  1. Application

Start by checking that the RTB can decide the issue. Select the relief you need and submit the proper application before time expires.

  2. Serving documents

Deliver the dispute notice and other documents using an authorized method. Record what was served, when and how.

  3. Evidence deadlines

Check the hearing package for the applicable evidence rules. Submit and serve relevant records on time, with labels that connect each item to the claimed remedy.

  4. Hearing

RTB hearings are usually remote, commonly by telephone conference. Use the telephone or video arrangements specified in your hearing notice; do not assume the hearing format.

  5. Decision

The written reasons explain the outcome; the order sets out what must be done. Keep both and identify any deadline or unmet obligation before taking further action.

  6. Review consideration

If an internal review is being considered, check the statutory grounds immediately. Its time limits vary and can be much shorter than the separate court-review period.

  7. Judicial review

BC Supreme Court can consider a judicial review on appropriate grounds. It is not a rehearing of every fact; seek advice about filing time and whether a stay is needed.

Key deadlines BC landlords and tenants miss

Keep a deadline record for your Nanaimo tenancy. Notice-dispute periods, deposit obligations and court-review limits address different steps and should not be confused.

Current BC rules differ from older online guides: landlord or purchaser occupancy generally uses a three-month notice with 21 days to dispute. A four-month demolition or conversion notice is not a renovation notice. Major renovations requiring vacant possession generally require the landlord to apply for an RTB order under section 49.2. Two-month notices now concern eligibility for subsidized housing, not landlord occupancy. Check the form, date of service and applicable rules before acting.

Questions about tenancy disputes in Nanaimo

Do I need a lawyer for an RTB hearing in Nanaimo?

You may attend an RTB hearing without counsel. Lawyers can nevertheless help assess notice requirements, service, evidence and possible remedies. A limited consultation may answer an immediate procedural question, while a contested hearing may call for more preparation; the scope should be discussed against your particular file. A cause notice needs review of the alleged ground and the accompanying records.

Can a Surrey-based firm represent me if I live in Nanaimo?

A BC resident can consult Khurana Law remotely about RTB representation. The firm does not require clients to travel for every discussion and does not imply a local office. Its Surrey and Vancouver lawyers can review the file, identify preparation tasks and coordinate attendance using the hearing package instructions. Send the entire notice, including attachments, for a remote consultation.

Can my landlord evict me in Nanaimo for renovations?

A renovation plan may lead to an RTB application, not an automatic eviction. The landlord generally needs an order addressing the statutory conditions for ending the tenancy for major work. Keep the application package and supporting material; your evidence should address the stated need for vacancy and other relevant requirements. A cause allegation should not be repackaged as a renovation ground.

How do I get my security deposit back in Nanaimo?

Give a written forwarding address, keep the delivery evidence and retain your inspection documents. The Act generally gives the landlord 15 days from the later of tenancy end and receipt of that address to repay or claim. Exceptions and consent to deductions need to be considered before an RTB application. A notice dispute does not remove the separate deposit obligations at tenancy end.

Can landlords in Nanaimo get help collecting unpaid rent?

A landlord can request advice on a rent claim, from calculation through potential enforcement. Evidence should establish the tenant’s obligation and account for every payment credited. The choice between notice, application and later collection steps depends on the relief needed; having a debt does not authorize a lockout. Calculate unpaid rent independently of any cause allegations.

How long does an RTB dispute take?

There is no single duration that applies to every RTB dispute. Timing depends on the application type, scheduling, service, evidence and whether a further step is needed after the decision. Urgent procedures have specific eligibility rules; do not assume an ordinary hearing will be expedited just because the situation feels pressing. Ongoing discussions do not necessarily pause the deadline to dispute the notice.
