Tenancy disputes we help with in Chilliwack

Notices to End Tenancy

Notice advice starts with the legal ground, the approved form and how the document was delivered. BC currently uses three-month landlord or purchaser occupancy notices; a renovation requiring vacant possession generally needs an RTB order rather than a landlord-issued renovation notice.

Disputing an eviction

The RTB can consider a timely application disputing a notice. Preparation includes the tenancy history, the document received and evidence that supports or contests the alleged basis for ending the tenancy.

Orders of possession

A landlord seeking the rental unit back may need an RTB possession order. Tenants should assess their response promptly, and both parties should understand the legal process before acting on an order.

Unpaid rent and damage claims

Unpaid rent is not the same issue as alleged property damage. We address each claim separately and explain the evidence needed to establish a loss or challenge the amount requested.

Security and pet damage deposits

We assess whether deposit money should be repaid or whether a properly supported RTB claim is needed. Ordinary wear, alleged damage and missed inspection requirements are not interchangeable issues.

Rent increases

We check the notice, timing and applicable legal limit for a proposed increase. No annual percentage is quoted here because the permitted figure is year-specific and exceptions require individual review.

Repairs and services

We help present evidence about unresolved maintenance and a loss of included services. Keep dated requests, responses and photographs; the right remedy depends on the obligation and the actual facts.

Quiet enjoyment

We assist with quiet-enjoyment applications and responses, including alleged interference with use of a rental home. Incident dates, communications and the impact claimed help define the dispute.

Enforcing RTB orders

An RTB decision does not always produce voluntary compliance. We advise on the court process appropriate to a monetary or possession order and the records needed to take the next lawful step.

For tenants in Chilliwack

Chilliwack tenants should ask what a disputed utility charge represents and keep the bills and agreement. An amount claimed by an owner is not necessarily the same as unpaid monthly rent. Preserve demands and notices so the correct response and deadline can be identified.

Prepare a dated sequence of requests, responses and events. Evidence that explains the specific loss or remedy you seek is more useful than a large folder of unexplained screenshots.

For landlords in Chilliwack

A Chilliwack landlord pursuing unpaid utilities should verify the agreement, calculation and required demand process. Do not simply combine every outstanding charge into rent arrears. A clear account of the obligation and the documents served helps explain the requested remedy.

Determine whether the Residential Tenancy Act covers the arrangement before filing. Shared accommodation, commercial use and other exclusions can require a different dispute route.

How the RTB dispute process works

Clients in Chilliwack often begin with a notice or a demand for money. The next question is which RTB remedy addresses it, followed by service, evidence and the scheduled hearing.

  1. Application

A filing should identify the dispute and requested remedy accurately. Confirm coverage, use the appropriate route and respect the relevant application deadline.

  2. Serving documents

Deliver the dispute notice and other documents using an authorized method. Record what was served, when and how.

  3. Evidence deadlines

Check the hearing package for the applicable evidence rules. Submit and serve relevant records on time, with labels that connect each item to the claimed remedy.

  4. Hearing

Confirm the hearing format and attendance details from the RTB package. Remote participation, commonly a telephone conference, still requires preparation and an accessible copy of your records.

  5. Decision

After the hearing, review the reasons and operative terms rather than relying on a brief summary. Record what compliance requires and whether anything remains outstanding.

  6. Review consideration

If an internal review is being considered, check the statutory grounds immediately. Its time limits vary and can be much shorter than the separate court-review period.

  7. Judicial review

BC Supreme Court can consider a judicial review on appropriate grounds. It is not a rehearing of every fact; seek advice about filing time and whether a stay is needed.

Key deadlines BC landlords and tenants miss

Tenancy deadlines apply across Fraser Valley, including Chilliwack. Keep the original documents and delivery records so the relevant period can be calculated against the actual facts.

Older two-month landlord-use advice does not describe the current occupancy procedure. BC generally uses a three-month occupancy notice, disputable within 21 days. Four-month demolition or conversion notices are separate from the RTB order procedure for major renovations. A two-month subsidized-housing notice addresses a different ground. Bring the actual form so the route and service date can be checked.

Questions about tenancy disputes in Chilliwack

Do I need a lawyer for an RTB hearing in Chilliwack?

Legal representation is optional at a residential tenancy hearing. A lawyer can assist with identifying the issue, selecting evidence and presenting a response, particularly where possession of the home is at stake. The first step is to understand the application and the deadline rather than assume all files need the same support. A utility demand and a rent notice may require different procedural analysis.

Can a Surrey-based firm represent me if I live in Chilliwack?

Yes, the firm’s provincial tenancy services are available through remote consultation. Its actual offices remain in Surrey and Vancouver, not in every community it serves. Share readable copies of the relevant documents and confirm the hearing format, language needs and attendance arrangements with the team before the scheduled date. Share the relevant bills with the lease for a useful remote review.

Can my landlord evict me in Chilliwack for renovations?

Your landlord must use the lawful route for the work proposed. For major renovations requiring the unit to be vacant, that generally means seeking an RTB order under section 49.2. Ordinary maintenance does not automatically terminate a tenancy, and a demolition notice should be reviewed as a separate document. A service interruption is not automatically a lawful basis for renovation eviction.

How do I get my security deposit back in Chilliwack?

Request repayment with a properly delivered written forwarding address. The ordinary deadline is 15 days after the later of the tenancy ending or the landlord receiving that address, subject to statutory exceptions. A contested deduction should be reviewed alongside inspection records and any written agreement authorizing retention of money. Any utility deduction from the deposit needs its own legal basis.

Can landlords in Chilliwack get help collecting unpaid rent?

Landlords can seek advice on an RTB claim for unpaid rent and later enforcement options. Preparation begins with the tenancy agreement, payment history and an explained balance. A notice ending the tenancy and a claim for money have different functions, so the intended remedy should be identified before filing. List utilities and monthly rent on separate lines with supporting records.

How long does an RTB dispute take?

An RTB dispute has a case-specific timetable, not a universal completion date. The application route, the assigned hearing and procedural requirements affect progress. A decision may also be followed by enforcement or review steps. Read the notice and evidence instructions instead of treating another person’s hearing experience as a prediction. The first relevant date may concern a demand rather than the hearing itself.
